The main principles of the LCD housing legislation of the Russian Federation (Art. 1) carries the realization by citizens enshrined in Art. 40 of the Constitution of the Russian Federation the right to housing, and cause them to housing rights at their own discretion and in its own interests. By virtue of the title of the legislative establishment of nationals in a market economy, ensure the implementation of housing rights of their own, using a variety of methods allowed by law. However, Art. 40 of the Constitution obliges the state authorities and local governments to create a low-income, other persons mentioned in law additional conditions for the realization of the right to housing by providing housing for free or at an affordable price from the state, municipal and other housing funds in accordance with statutory regulations. Specifying the said constitutional obligation, the federal legislator secured in the Housing Code, that the organs of state power and local self-government within their competence, shall provide the conditions for citizens to exercise the right to housing by providing them with premises under contracts of social hiring or residential tenancy agreement state or municipal housing (para. 3, Art. 2).
